The South Dakota School of Mines & Technology (SD Mines) supports the protection and privacy of information submitted by our students, faculty, staff and visitors to our official website.  This does not apply to websites not officially recognized or maintained by the university, such as those independently created by faculty, staff or students.

Information Provided Voluntarily

Personal information is collected from you when you fill out any of the forms on our website or an application for admission.  As a student, faculty or staff member, access to private data requires user authentication.  Once logged in, you may be asked to provide information such as name, student ID number, address, date of birth, etc.  While authenticated, you may also access and interact with private information, such as grades, enrollment or other privileged information.  Such information remains under your control and may only be shared with others by your direct action.  SD Mines complies with the Family Educational Rights and Privacy Act (FERPA) which requires, with some exceptions, the student’s consent prior to the disclosure of personally identifiable information within educational records. We do not sell or share personal information collected through our website.

Use of Information

SD Mines will only use your personal data on a lawful basis to fulfill our legitimate educational interest with that information. SD Mines may use information collected from your visit to this website to manage and improve the user experience and preferences associated with this website and SD Mines communications; track how often people gain access to or read SD Mines content; foster further communications; invite and/or register you (upon request) to events that may be of interest to you; fulfill your online requests for goods or services; and for online advertising through third party vendors, such as Google, Facebook or other social media platforms.

Sharing of Information

SD Mines may use third party service providers and suppliers to facilitate this website or the services SD Mines provides. Those providers and suppliers may have access to the information SD Mines collects in order to fulfill their obligations to SD Mines.  SD Mines is a state institution, and as such may disclose or share information in recognition of applicable state, federal, or international laws.  This includes but is not limited to the Higher Education Opportunity Act (HEOA), Family Educational Rights and Privacy Act (FERPA), the Health Insurance Portability and Accountability Act (HIPAA), and South Dakota Public Records Law.

Applicable laws may give you additional rights to request access to, or to request the erasure, correction or transfer of, your data.  For example, the European Union’s General Data Protection Regulation (EU GDPR) provides certain rights to persons who were/are residing in the European Union when data is collected. If the EU GDPR applies to your data then you may ask to see your data or request, to the extent allowed by law and feasible based on your relationship with the university, to have your data corrected or erased. You may also object to or request restrictions on how your data will be processed. You may ask that your data be forwarded or transferred to another organization. Finally, to the extent allowed by law, you may withdraw consent you have given to certain data processing, without penalty. If you do decide to withdraw consent at a later date, your withdrawal will not affect the legality of the processing of your data up to that point.
